İL VE İLÇE MÜFTÜLERİNE NİKAH KIYMA YETKİSİ VERİLMESİNE DAİR YASA TASARISINA İLİŞKİN BASIN AÇIKLAMASI

İL VE İLÇE MÜFTÜLERİNE NİKAH KIYMA YETKİSİ VERİLMESİNE DAİR YASA TASARISINA İLİŞKİN BASIN AÇIKLAMASI

25 Temmuz 2017 tarihinde, Bakanlar Kurulu tarafından TBMM’ye sunulan “Nüfus Hizmetleri ile Bazı Kanunlarda Değişiklik Yapılmasına Dair Yasa Tasarısının” 6.maddesi ile il ve ilçe müftülüklerine de resmi nikah kıyma ve evlendirme memurluğu yetki ve görevi verilmesi gündeme getirilmiştir.

Türkiye Cumhuriyet Anayasasının “Cumhuriyetin Nitelikleri” başlıklı ikinci maddesi uyarınca; “Türkiye Cumhuriyeti, toplumun huzuru, milli dayanışma ve adalet anlayışı içinde, insan haklarına saygılı, Atatürk milliyetçiliğine bağlı, başlangıçta belirtilen temel ilkelere dayanan, demokratik, laik ve sosyal bir hukuk Devletidir.”  Yine Türkiye Cumhuriyet Anayasasının “Değiştirilemeyecek Hükümler” başlıklı dördüncü maddesi uyarınca; “Anayasanın 1 inci maddesindeki Devletin şeklinin Cumhuriyet olduğu hakkındaki hüküm ile, 2. maddesindeki Cumhuriyetin nitelikleri ve 3 üncü maddesi hükümleri değiştirilemez ve değiştirilmesi teklif edilemez.”

Açıkça Türkiye Cumhuriyet Anayasası’nın 4.maddesi ile değiştirilemeyecek ya da değiştirilmesi teklif dahi edilemeyecek hükümlerden sayılan ve 2. maddesi ile hüküm altına alınan “laiklik” ilkesine aykırı şekilde; sadece müftülere tanınan bir yetki ile Medeni Hukuk’un temel akitlerinden birisi olan evlilik akdini kurma yetkisinin dini görevleri yerine getirilmesi ile görevlendirilen bir yetkiliye devrinin, hukuka aykırı olduğu açıktır. Maksat dini vecibelerin yerine getirilmesinin kolaylaştırılması ise mevcut mevzuat uyarınca resmi nikah akdini yapan çiftlerin talep edenlerin imam nikahı olarak adlandırılan dini vecibelerini yerine getirmelerini  engelleyen hiçbir mevzuat hükmü de bulunmamaktadır. Bu durum ileride diğer din ve mezhep mensuplarının kendi dini vecibeleri doğrultusunda nikah kıyma yetkisini talep etmelerini ve dinin hukuki bir sözleşme olan nikah akdinin tescilinde önemli bir ayrışma noktası haline gelmesine sebep olması sonucunu doğuracaktır ki, bu durumun da toplumsal barışı zedeleyerek ayrışmalara yol açacağı aşikardır.

Devletin temel görevi toplumsal ayrılıkları değil toplumsal kaynaşmaların önünü açmak olup, teklifin buna hizmet etmediği görünen gerçektir. Amaçlanan resmi nikahtan sonra isteyenin kıydırdığı dini nikah işleminin, daha düzenli ve güzel ortamlarda yapılabilmesi ise bu durum diyanet işleri başkanlığının müftülüklere göndereceği bir yazı ile mümkündür ve buna bir diyeceğimiz yoktur. ama resmi nikah işleminin müftülüklerce de yapılması, belirttiğimiz üzere anayasamıza aykırı olduğu gibi toplumsal barışımıza da hizmet etmez.

Hal böyle iken; doğrudan Türkiye Cumhuriyeti Anayasası’nın ikinci maddesindeki “laiklik” hükmüne aykırılık teşkil etmesi sebebiyle hukuka aykırılığı tartışmasız bir hükmün, TBMM’ye tasarı olarak getirilmesi hukuk devleti ilkesi ile de bağdaşmayacaktır. Bu durum ayrıca Türkiye Cumhuriyeti Anayasası’nın 4.maddesinin de etrafından dolaşılması sonucunu da doğuracağı ve anayasa ile güvence altına alınan ilkelerin kanun ile bertaraf edilmesinin yolunu açacağı kaygısındayız.

Nüfus Hizmetleri ile Bazı Kanunlarda Değişiklik Yapılmasına Dair Yasa Tasarısının Türkiye Cumhuriyeti Anayasasının temel ilkelerine aykırılık teşkil edecek söz konusu maddenin yetkili makamlar tarafından gerekli hukuk devleti hassasiyeti ile kanunlaşmaması yönünde irade göstermelerini ve bu konuda gerekli adımları atmalarını bekliyoruz.
