PKK TERÖR ÖRGÜTÜ İLE BAĞLANTISI TESPİT EDİLEN ÖĞRETMENLER HAKKINDA AÇIKLAMA
Başbakan Binali Yıldırım’ın geçtiğimiz günlerde yaptığı açıklamada; “Terör örgütüyle bir şekilde ilişkiye girmiş öğretmenleri de değiştiriyoruz. Buna karar aldık. 14 bin civarında öğretmeni, maalesef başka yerlere alma mecburiyeti var. Bunlar eğitim yerine terör örgütünün amaçlarına hizmet eder hale gelmişler.”ifadelerine yer vermiştir. PKK terör örgütü ile ilişkili öğretmenler bulunduğu ve bunların sayısının 14 bin gibi vahim rakamlara ulaştığı ve bahsedilen bu kişilerin yerlerinin değiştirilerek terör örgütünün amaçlarına hizmet etmesinin engelleneceği beyan edilmiştir.
Türkiye Cumhuriyeti, Anayasasının 2.maddesi uyarınca bir hukuk devletidir. Terör örgütü olduğu, bir çok yargı kararı ile ülkemiz ve uluslararası kuruluşlar tarafından kabul edilen PKK ile ilişkisi olan kişilerin sadece yerlerinin değiştirilerek memuriyete devamlarının sağlanması ve hatta ülkemizin geleceği çocuklarımızın ve gençlerimizin eğitiminde görevlendirilmesi açıkça 3713 sayılı Terörle Mücadele Kanununa ve Türkiye Cumhuriyeti Anayasasının hukuk devleti niteliğini düzenleyen 2.maddesi ile eğitim ve öğretim hakkını düzenleyen 42.maddesine aykırılık teşkil etmektedir.
“Atatürk ilkeleri ve inkılapları doğrultusunda, çağdaş bilim ve eğitim esaslarına göre; ” Eğitim ve öğretim alma hakkı” Anayasa ile korunan vatandaşlarımızın PKK terör örgütü ile ilişkisi saptanan öğretmenler vasıtasıyla eğitim ve öğretime tabi tutulması ya da çocuklarına eğitim ve öğretim verilmesi açıkça hukuka aykırılık teşkil edeceğinden, söz konusu öğretmenlerin memuriyetten uzaklaştırılması, hatta bağlantısı ve eylemi sabit olanlar hakkında gerekli adli tahkikatin yapılması hukuk devletinin gereğidir.
Bu nedenle kamu gücünü elinde bulunduran yetkililerden ve söz konusu açıklama ışığında yetkili yargı mercilerinden PKK terör örgütü ile ilişkisi bulunan kişilerin öğretmenlik ve kamu görevi ile ilişiklerinin kesilmesi ve gerekli adli soruşturmanın başlatılması için ivedilikle gereğinin yapılmasını bekliyor; aynı hassasiyetin yüksek öğretim kurumlarında da sergilenerek üniversitelerin terör örgütlerinden bir an önce temizlenmesini talep ediyor, konunun takipçisi olacağımızı tüm kamuoyuna ve Türk Milletine saygı ile duyuruyoruz.
