​Hukuki Mücadele Derneği 25.05.2016 tarihinde tüzüğünün 2.maddesi uyarınca; “Türk hukukunun gelişmesine, Türkiye’de hukuk devleti ilkesinin kurum ve kurallarıyla yerleşmesine, hukukçular arasında birlik ve mesleki dayanışmanın sağlanmasına katkıda bulunmak, toplumsal ya da bireysel şiddet, terör, soykırım, işkence vs benzeri suçların bertaraf edilmesi, suç mağdurlarının korunması ve suçluların cezalandırılması maksadıyla hukukun izin verdiği ve mevzuatın çizdiği sınırlar dahilinde ulusal ve uluslararası mecrada mücadele etmek” maksadıyla kurularak faaliyete geçmiş bir sivil toplum örgütüdür.

​Derneğimiz üyeleri tarafından sosyal medyada rastlanılan ve dilekçemiz ekinde bir örneğini sunduğumuz, Hacettepe Üniversitesinin Hukuk Müşavirliği adına Prof. Dr. A. Haluk ÖZEN tarafından imzalanan 97147151/SM.ÖS -1203 -6215 sayılı 22.11.2016 tarihli soruşturma dosyası ile 5237 sayılı TCK anlamında suç olmamakla birlikte ifade özgürlüğü ve Anayasa’nın 26.maddesi uyarınca düşünceyi yayma ve açıklama hürriyetine ve yine Anayasa’nın 34.maddesindeki toplantı ve gösteri yüryüşü düzenleme hakkı kapsamında terör örgütüne karşı atılan ekteki yazıda belirtilen sloganlar sebebiyle “kişilerin şeref ve haysiyetini zedeleyen sözlü veya yazılı eylemlerde bulunmak” gerekçesiyle bazı öğrencilere disiplin cezası verildiği anlaşılmıştır. Söz konusu disiplin cezasının verilmesine dayanak teşkil eden gerekçe açıkça hukuka aykırı olmakla birlikte suç unsurları barındırmaktadır.

PKK, gerek Türkiye Cumhuriyeti’nin yetkili makamları gerekse Türk Milleti adına yargılama yapan Mahkemelerce ve uluslararası kuruluşlar tarafından terör örgütü kapsamında değerlendirilen; ülkemizin milli birlik ve bütünlüğüne karşı silahlı eylemlerde bulunan ve bir çok masumun ölümüne sebebiyet vermiş bir “Terör Örgütü” olduğu tartışmasızdır. Ege Üniversitesinde 2015 yılında yaşanan benzer olaylar neticesinde PKK’lılar tarafından katledilen Fırat Çakıroğlu’nun akıbetinin Hacettepeli öğrencilerin yaşamaması için gerekli tedbirleri almak bir yana PKK sempatizanlarına karşı demokratik haklarını kullanmalarını engelleyen ve öğrencilerin baskı altına alınması sonucunu doğuran disiplin uygulamalarıyla ortaya konulan fiillerin suç oluşturanlarının tecziyesi maksadıyla Savcılığa suç duyrusunda bulunuyoruz.
