25 KASIM KADINA YÖNELİK ŞİDDETE KARŞI MÜCADELE VE ULUSLARARASI DAYANIŞMA GÜNÜ BASIN AÇIKLAMASI

25 Kasım, Dominik Cumhuriyeti’nde,Salcedo’da Ojo de Agua adlı köyde doğmuş Trujillo diktatörlüğüne karşı mücadele eden Clandestina Hareketi’nin öncülerinden olan Patria, Minerva ve Maria Mirabel kardeşlerin sistem tarafından katledildiği tarihtir. Mirabel kız kardeşlerin, diktatörlüğün askerleri tarafından, tecavüz edildikten sonra vahşi bir şekilde katledildikleri, utanç gününün ve insanlık ayıbının yıl dönümüdür.

Bu yıl dönümü önce 1981’de Dominik’te toplanan Latin Amerika Kadın kurultayında; 25 Kasım , “Kadına Yönelik Şiddete Karşı Mücadele Ve Uluslararası Dayanışma Günü” olarak kabul edilir. Daha sonra 1985 yılında, BM tarafından “25 Kasım, kadına yönelik şiddetin yok edilmesi için uluslararası mücadele” günü ilan edilmiştir.

Kadınlar dün olduğu gibi bugün de dünyanın her yerinde ulusal, sınıfsal, cinsel sömürüye uğruyor, ulusal, sınıfsal saldırılara maruz kalmaktadır.

Kadına yönelik şiddetin bildik hüzünlü öyküleri, geleneksel ön kabuller, toplumun ve devletin duyarsızlığı ile büyüyor. Şiddet yalnızca bedenlere zarar vermiyor, kadınların öz saygısını, ihlale direnme ve hak arama arzusunu zayıflatmakta veya yok etmektedir.

Dünyada kadına yönelik şiddet, özellikle ekonomik, siyasal ve etnik sorunlarla iç içe geçerek artmaktadır. Nijerya’da, Emine Laval’ın evlilik dışı çocuk sahibi olduğu gerekçesiyle şeriat mahkemesi, Mardin’de Şemsiye Allak’ın ailesi tarafından taşlanarak öldürülmesine karar verilmesi bunun en somut ve güncel örnekleridir.

-Bugün dünya üzerinde yaşayan kadınların yarısı eşlerinden şiddet görmekte,

-Çin’de, yılda 1 milyon kız çocuğu doğar doğmaz öldürülüyor. Dünyada bu yolla kaybedilen kadın sayısı 40-50 milyonu bulmakta,

-Uluslararası Göç Örgütü, her yıl 2 milyon kadının sınır ötesi kadın ticaretinde kullanıldığından bahsetmektedir.

-ABD’de, her 6 dakikada bir kadına tecavüz edilmekte,

-İngiltere’de, her 7 kadından biri birlikte olduğu erkek tarafından tecavüze uğramaktadır.

-Fransa’da, her ay 6 kadın aile içi şiddet nedeniyle hayatını kaybetmektedir.

Bunlarla birlikte, paylaşım savaşları, işgaller, ağır ekonomik bunalımlar ve yoksulluk kadınları şiddet cenderesine daha fazla itmektedir.

Türk örfünden ve kültüründen gün geçtikçe uzaklaşarak arabesk bir kültürün etkisine giren ve din istismarcılarının çoğaldığı günümüz Türkiye’sinde de maalesef kadınların büyük çoğunluğu şiddet görmektedir.

Türkiye’de son 5 yılda öldürülen kadınlardan;
608’inin faili kocası veya eski kocası, 161’inin faili erkek arkadaşı veya eski erkek arkadaşı, 213’ünün faili ailedeki erkekler (babası, oğlu, erkek kardeşi, damadı, kayınpederi) veya akrabası olduğu tespit edilmiştir.

Kadına karşı şiddetlerin ve cinayetlerin önüne geçebilmek için uygun yasalar hazırlanılmasından önce, ailede ve toplumda bu yetiştirilme sorunları aşılmalı, temel eğitimde, hatta ana sınıfında bu yönde eğitim metotlarıyla dersler verilmeli, toplumsal cinsiyet eşitliği sağlanmalıdır.

Bu şartlar gerçekleşmeden yasaların bir anlamı kalmamakta, her gün çığ gibi büyüyen kadına yönelik şiddet, öldürme fiillerinin önüne geçilememektedir. Risk gruplarına, şiddetle sık karşılaşan meslek grupları ile kamuya yönelik eğitim ve bilgilendirme çalışmalarına hız verilmelidir.
Ayrıca cinsel taciz ve istismar davalarında mağdurların defalarca mağdur edilmesine, şiddet uygulayanların ise yeni suçlar işlemek üzere tahliyelerine yol açan uygulamaların terk edilmesi sağlanmalıdır.

Tecavüze uğrayan kız çocuklarının ruhsal bütünlüğünün zedelenip zedelenmediğini soruşturan, kadın katillerine “haksız tahrik” adı altında ceza indirimi sağlayan erkek egemen adaleti değil, gerçek adalet hakim kılınmalıdır. Güncel konulardan biri olan çocukların cinsel istismarındayız kanunlaştırma çalışmalarından da görüldüğü üzere toplumun her kesiminde bulunan hassasiyetler maalesef yasa koyucuların tarafından yeterince dikkate alınmamakta, kadını ve çocuğu odağa alan yasama politikası halen yasa koyucu tarafından içselleştirilememiştir.

Ülkemizin kurucusu ulu önder Mustafa Kemal Atatürk’ün “Ey kahraman Türk kadını, sen yerde sürüklenmeye değil, omuzlar üzerinde göklere yükselmeye layıksın.” sözlerini kendisine ilke edinmiş Hukuki Mücadele Derneği üyesi Milliyetçi Avukatlar olarak insan hakları mücadelesinde çerçevesinde kadına yönelik her türlü ayrımcılığı; emeğine, bedenine ve kimliğine yönelik şiddeti reddediyor, demokrasiye ve eşit yurttaşlığa gönülden bağlı herkesi ve görevli tüm kurumları bir kez daha kadına karşı şiddete karşı mücadeleye çağırıyor; çağ dışı, Türk örfünde bulunmayan, arabesk kültür anlayışı ile şiddeti ve kadına karşı ayrımcılığı kendisinde hak görenlerin layık oldukları şekilde cezalandırılmaları için gerekli çabayı göstereceğimizi kamuoyuna ve Türk Milletine saygı ile duyuruyoruz.
